Webinar Description:   

An in-depth analysis of lessons learned from defending high exposure and catastrophic claims and what tools can be successfully implemented to coordinate discovery efforts and prepare transportation entities for a successful defense, including through the time of trial. This evaluation will include the benefits of coordinated discovery efforts nation-wide (and the risks of failing to make such coordination efforts), consistent implementation of policies and procedures (and the dangers of policies and procedures which “advance” the standards of reasonableness and care unknowingly), the detailed preparation (and associated dangers) of both driver and 30(b)(6) depositions, and strategies to defeat claims for negligent hiring and retention. We will address the need to identify a consistent defense story, make suggestions on how handle the judgmental eye of the public, and how to balance the competing needs for drivers with the need for skilled professionals. And the discussion will highlight the need for a cooperative tri-partite relationship between client, attorney, and insurer to set the claim up for success.

About the Presenters:

Stephanie M. Chesney, Partner, MG+M

Stephanie Chesney is an experienced litigator with significant experience defending a wide variety of civil cases from pre-suit through trial. Her experience includes representing clients in a variety of business and commercial litigation matters, including employment matters, general liability, transportation, products liability, construction, and premises liability. Stephanie also handles professional liability matters in the defense of health care providers and institutions. She has extensive courtroom experience defending claims in the state and federal courts of Massachusetts and Maine. Stephanie has additional experience providing risk transfer and tender advice to clients, as well as advising regarding risk mitigation strategies. Prior to joining MG+M, Stephanie practiced with a number of regional law firms where she specialized in a variety of complex litigation matters, primarily related to professional liability and the defense of health care providers. She was recognized as a Massachusetts Super Lawyers Rising Star from 2012–2018 and 2020–2022, and as a Rising Star by the National Bar Journal in 2015. In addition, Stephanie was an adjunct professor at New England Law Boston from 2011–2019 where she enjoyed teaching first year law students Legal Research and Writing.

Hillary has over 20 years of experience as an insurance claims leader, insurance broker and insurance investment manager. She began her career as an adjuster at Infinity Property & Casualty Corporation (Kemper) in Los Angeles, California, and then moved into claims management positions, and most recently held the position of Claim Director of Chubb’s East Coast TPA Oversight Division in New Jersey/New York City. Hillary has claims handling experience handling all lines of business.  She brings technical coverage expertise and risk management strategies to her current position. Her expertise includes real estate, food and beverage, hospitality, construction, general liability, transportation, financial lines and New York Labor Law. She has implemented and managed large claim programs with self-insured, carriers, TPAs, MGAs, and captives, and supervised a team of nine claims managers and eighty-nine claims adjusters across the country. Hillary specializes in complex coverage and high-severity claims in the general liability, product liability, property, construction, umbrella and high excess spaces. She is considered a subject matter expert on contractual defense and indemnity, additional insured coverage and New York Labor Law.  Along with strong technical expertise, Hillary brings a wealth of knowledge related to customer service and account management as a former business owner.
